Acceptance of Terms of Use

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS WEBSITE.

All users of www.splerin.com  (the "Site") and Club Splerin the unique Membership-Only, Personalised & Confidential Rental Wardrobe Service, rental and sale of products (this "Service") agree that access to and use of this Site are subject to the following terms and conditions in accordance with Club Splerin Membership Levels (SEE Club Splerin Membership Pack). In these Terms and Conditions, “you” and “your” refer to all Users / Members of this site and “we”, “us” and “our” refer to Club Splerin, Splerin. References to users must be read as being also reference to “our” customers. If you do not agree to these Terms and Conditions, please do not use this Site.

These Terms and Conditions are an ongoing binding legal contract between you and Club Splerin / Splerin and Associates.

Disclaimer

We are offering Membership-only, Personalised & Confidential Rental Wardrobe Service. Our Collection has been created with the memory of one little girl adoring the freedom of a Butterfly and always preparing to fly with it. In this collection, Splerin and its designers strive to merge the twin inspirations of butterfly itself as a symbol of our life, its metamorphisms, other people - and butterfly as experienced through an innocent young girl's eyes and memory. Through this synthesis, Splerin succeeds in creating new forms of simple sophistication in its commitment to classic design purity. A major focus will always be on maintaining Splerin value; more importantly we are driven by two key aspirations - Creativity and Quality.

We proudly stand behind the authenticity of our designs. We expressly disclaim any suggestion that we are an authorised dealer or agent of any other brand or designers whose goods are offered for rent or sale on this Site. While many of the products available for rent or sale at Club Splerin / Splerin are current season, equally some might not be. Regarding this, we expressly disclaim any suggestion that all items available are from current season collections.

You must be 18 or older, or have parental consent if between 15 and 18, to become a member of and rent or purchase from Club Splerin / Splerin.

At all times it is the responsibility of the Member to make sure that we have the correct delivery address. If the delivery address is different from your main residence, it is also part of our Terms & Conditions that we are notified of this.  All our deliveries will be signed for before reception. If there is no-one available to sign at the time of delivery, the package will be taken to the nearest local depot, and a card will be left at the delivery address giving all contact and collection details.

Changes to Terms & Conditions

These Terms of Use are subject to change by Club Splerin / Splerin at any time, in our sole and absolute discretion, with or without advance notice to you. The most current version of the Terms of Use can be viewed by clicking on the "Terms & Conditions" located on the bottom of the pages of the site www.splerin.com . The most current version on our site will always supersede any previous version in both electronic and paper or hard copy. Your use of our website or continued use of our service after changes are made means that you agree to be bound by these changes. As such, please read these Terms & Conditions periodically.

Privacy Policy

Club Splerin / Splerin personal information practices on this Site are governed by our Privacy Policy. Please review this privacy statement and print a copy for your records and please also be advised that you must review on regular basis our site by clicking on the "Terms & Conditions" located on the bottom of the pages of the site www.splerin.com  for the most current version.

Our Service

Club Splerin is part an online service which provides its members the ability to rent or purchase authentic designer clothing from Club Splerin and Splerin at significant discounts according to our Terms & Conditions, with pay and various membership Levels (SEE OUR MEMBERSHIP PACK & BENEFITS FOR FULL DETAILS), members select our designer dresses from their Personalised & Confidential Virtual Rental Wardrobe provided (subject to membership level), receive them at their home or registered “Delivery Address” via our appointed courier  and after use, simply return them either by scheduling a pickup with our appointed courier  or by dropping them off at their local post office with prepaid return labels, with no due dates or late fees provided this is done before or the day we have requested the dress or dresses to be sent out, back to us. It is the member's responsibility to adhere to our strict Terms & Conditions. Rental is automatically renewed at the same applicable rental and charges should the member decide to keep the dress for longer and subject to their membership level and our Membership Pack & Benefits. Please be advised that our Membership Pack & Benefits needs to be used always in conjunction with our general Terms & Conditions). Our membership plan (SEE OUR MEMBERSHIP PACK & BENEFITS) allows members to rent as many articles of clothing as they choose, however, we reserve the right to limit the number of items any member can rent or purchase at one time, and to deny rental/purchasing rights at any time, for any reason we deem relevant. If you have the maximum number of Club Splerin online rentals allowed by your membership level checked out, no additional rentals will be shipped until you return one or more of the outstanding rentals.  

Club Splerin is a unique Membership-Only, Personalised & Confidential Rental Wardrobe Service, which allows you to rent a dress or dresses on a weekly, fortnightly or monthly basis according to your individually customised Club membership arrangements.

YOU NEED TO BE A MEMBER TO USE THE CLUB SPLERIN SERVICES.

Any items shipped will be either brand new or freshly organically dry-cleaned. Most orders will be shipped same day on our Basic Shipping Option, provided payment is cleared by 3pm London (UK Time), and will be delivered within 2 - 3 business days. However we make no guarantee of same day shipment or of delivery date or time. Some factors that can contribute to delay in shipment or delivery include, but are not limited to, the following:

  1. availability of product,
  2. cleared payment,
  3. member's delivery address,
  4. unanticipated downtime of our computer systems
  5. factors once in our appointed courier possession, including among other factors, inclement weather and/or heavier mailing volumes.

Once we give our carrier the order, the risk of loss is passed on to the member. Club Splerin / Splerin will notify the member once the order has been shipped, and will charge the first week’s rental fee at time of shipment. We will charge a second week’s fee if it is in member’s possession seven days after member has RECEIVED the order. Thus, members will not be charged for time order is in shipping carrier’s possession. If it is postmarked by our appointed courier and shipped back within seven days of receiving it, there will be no additional fees. We will send an email once return shipments are received.

At all times it is the responsibility of the Member to make sure that we have the correct delivery address. If the delivery address is different from your main residence, it is part of our Terms & Conditions that we are notified in this respect. 

There is a risk of loss during shipment for all items rented / purchased from us. We will deliver all items to our carrier, but this does not guarantee delivery to you. Please contact us if you do not receive your order.

Late Returns

If a member chooses to hold on to an item beyond the rental period paid for, she/he will be charged weekly for each additional week the item is retained beyond the agreed and paid for rental period, until such a time as the item is either returned to us or we have been notified of an intention to purchase. Every sequential weekly fee will be charged in advance seven days after any previous weekly late return fee, in accordance with membership details in our Membership Pack and the Membership Level of the customer.

Pricing

We reserve the right to change the price, content or Terms & Conditions of our Service at any time. We will not be held liable to you or any third party for any such changes to the Terms & Conditions.

Membership and Billing

Members can find specific details regarding membership with Club Splerin / Splerin at any time by clicking on the "My Account" link, located at the top of our website pages. You must be 18 years old or older to become a member of this Site.

To use the Service, you must register as a member through the site and set up an account providing us with your name, shipping address and e-mail address. By requesting membership with Club Splerin / Splerin and by accepting the benefits of the Service we provide, you agree to allow us to carry out a credit check on you at our sole discretion. You can cancel your membership at any time by email, or by a phone call to customer service backed by email. We reserve the right to suspend or terminate your membership at any time, at our sole and absolute discretion. You agree to provide and, if necessary, update wholly true, accurate, current and complete information about yourself at membership registration and when necessary at later times. Any such information provided or excluded that contradicts with this policy warrants suspension or termination of membership. It is your sole responsibility to maintain the confidentiality of your account and password.

Membership is NOT FREE and allows certain benefits and agreed FREE SPECIFIC rental, however, you authorise us to bill your credit card / account for rental, purchase, cleaning and/or alteration fees, any VAT at prevailing current rate if and as applicable, shipping fees and any additional charges you incur in connection with your account as stated. You will be charged every seven days in advance for weekly rental fees for every week you hold onto rentals plus security deposit should you exceed your total allowances and security deposit not yet paid (SEE YOUR MEMBERSHIP PACK & BENEFITS)

You will not be provided with copies of charge slips evidencing the recurring charges of the applicable rental. You agree to pay the applicable fees (plus VAT at prevailing current rate as applicable) in accordance with your Payment Method issuer agreement, if applicable. You also authorise Club Splerin / Splerin to charge your payment method for any other charges you may incur associated with your rentals and/or purchases. If we cannot collect payment from your credit card for any reason whatsoever, including expiration or over the card limits, payment is due immediately, and we reserve the right to obtain payment by any means necessary including but not limited to third-party collection agencies. If we find the credit card you provided is not pre-authorised to cover fees associated with the rental, we may deny rental at our sole and absolute discretion. If we notice we’ve under charged payment even at our own mistake, we reserve the right to correct such errors. It is your responsibility to pay all fees associated by your use of the Service charged by your credit card’s issuer including, but not limited to, over the limit and insufficient funds. It is your responsibility to notify us of any billing errors within 60 days after they appear on your statement; otherwise you agree to waive your right to dispute them.

Dress Rentals

Club Splerin is a unique Membership-Only, Personalised & Confidential Rental Wardrobe Service.

Registered Club Splerin members, please login here with the Username and Password we have provided you with, and then browse through your “Virtual Wardrobe” containing the dresses available to you, subject to your MEMBERSHIP LEVEL and BENEFITS, and all Terms & Conditions.

After finding the one you like, click on your correct size and for how many days you would like to rent it for. Check "CHECK OUT" for any further instructions and availability, plus payment options. Then click on the "Request" button. The dress will then be delivered to you at the address you provided subject to our Terms & Conditions and your MEMBERSHIP LEVEL & BENEFITS. (Please make sure that your address is correct when requesting).

Simply wear the dress and then return it back to us within the time allocated. You will receive a letter plus Invoice/Statement with your garment explaining exactly how to return your dress. Please ensure you do not exceed the time limit so that you do not incur further costs

.

Shipping and handling costs

There is a set Fee for all our shipping and handling costs, depending on your level of membership. Please see our Membership Pack or apply for membership using our Club Splerin Membership Application Form.

Shipping and handling costs vary and certain membership levels will qualify for free shipping and handling.  Our shipping and handling charges include the cost of returning garments to us, as well as insurance cover while garments are in transit.

Shipping and handling charges will be added automatically at the checkout and there is a standard charge for delivery anywhere in the UK. Deliveries to Ireland and mainland Europe have slightly higher shipping and handling costs - please contact us for an exact quotation.

ALL OUR DELIVERIES MUST BE SIGNED FOR.

Delivery cost

Our UK Delivery Cost is £11.99 per garment. This is a standard service and your dress will arrive within 2-3 days.

Purchase of rental dresses

If you borrow a dress and love it so much that you want to purchase it, please email us at store@splerin.com or call us on +44 (0) 7883356359. If the dress is available for purchase we will make the necessary arrangements. Please also see our Membership Pack for more information

Condition of our Dresses

Club Splerin garments are mainly from Splerin and a major focus will always be on maintaining Splerin / Club Splerin value and service. Even more importantly we are driven by two key aspirations - Creativity and Quality.

If a dress has any fault at all we will never knowingly send it to you and we check every garment with the utmost attention before it goes out to you.

Most of our garments will be coming to you with their Tags still attached (and will often be brand new); Please only remove the Tags after you have decided that the dress fits and that you will be wearing it. See our Membership Pack for further details.

Any Tags removed from a dress that is returned due to incorrect sizing or for any Non-Valid reasons will not be accepted as a free return and the original rental fee will be charged.

Colours

We have made every effort to display as accurately as possible the colours of our products that appear on the Site. We cannot guarantee that your computer monitor’s display of any colour will be accurate.

Responsibility for dry cleaning

We are responsible for all the cleaning involved with the dresses. PLEASE DO NOT ATTEMPT TO CLEAN ANY OF OUR GARMENTS YOURSELF or give them to anyone else for cleaning. If you stain or damage any of our garments in any way, don’t panic - just complete the “Return Card” with details of what caused the stain or other damage and which parts of the garment have been affected. Please send the “Return Card” with the dress and we will take care of it. Obviously, if a dress is beyond repair, you will be charged for this at the purchase price and subjected to the benefits your membership level entitled you to.

Wrong order

Before you become a Club Splerin Member, our Personal Stylists / Consultants will make sure that we have as much information as possible about the dresses that are made available just for you in your “Personalised Virtual Wardrobe”, so wrong orders (such as wrong size) are most unlikely to occur.

 

If still not sure, closer to when you might require a dress, you are more than welcome to send us your measurement so that we can suggest a size for you for a particular dress.

However in case you want to return a dress, please contact us ASAP by email or phone to let us know you will be returning the dress

Please note that it is part of our Terms & Conditions that all dresses must be signed for upon delivery, and also that you must let us know within two hours of receiving the dress if you wish to return it.

You can return a dress free of charge, but you will be responsible for paying for the return postage.

Returning a dress after rental

When you first received the dress, included in the package you will find “Return Instructions” - follow what these say. Or simply just use the stamps provided and send the dress back to us by recorded delivery via your local post office. The insurance will have been taken care of (included in the rental fee). Cancellation and Returns

As long as you have no outstanding orders and rentals in your possession, you may cancel your membership to Club Splerin at anytime. Failure to return rentals will result in your credit card being charged for up to the full retail price for such items minus the rental fee already collected by the renter’s credit card. We will send a reminder email regarding unreturned items prior to charging your credit card.

We reserve the right to suspend or terminate your account with us for any or no reason.

Rentals are returnable and rental/cleaning fees are refundable if the member notifies us of the issue by telephone or email, and obtains from us a Member Return Code (as this is not a normal rental return), and then returns the item(s) clearly marked with the Member Return Code on the outside of the box and all packing information inside the box within three (3) days. Shipping costs are non-refundable. In the event of a return, shipping charges may be higher than the original standard charge, as we incur a loss when shipping. The full shipment charge that we are charged by the carrier for your shipment and return will be passed onto the member in the event of a return. To prevent fraud, we reserve the right to decline rental/cleaning refund if the item fails our visible and invisible return inspection and either appears to have been worn, smells worn, or has wearing dirt or damage markings. If a member chooses to order more than one dress to try them on for the purpose of selecting one, we reserve the right to deduct £15.00 per dress for the return to cover the second return’s shipping and handling.

All purchases of items made in our "Sale" section are returnable and sale prices are refundable if the member notifies us of the issue, obtains a Member Return Code, and returns the item(s) clearly marked with the return code on the outside of the box and all packing information inside the box within seven (7) days. Shipping costs are non-refundable. In the event of a return, shipping charges may be higher than the original standard. The full shipment charge that we are charged by the carrier for your shipment and return will be passed onto the member in the event of a return. To prevent fraud, we reserve the right to decline refund if the item fails our 10 step visible and invisible return inspection and either appears to have been worn, smells worn, or has any wearing dirt or damage markings. Any and all other purchases made from Splerin/Club Splerin are final sale and non-refundable.

All refunds are made to the Retail Payment Method used for the original rental/purchase. We reserve the right to suspend/terminate membership for customers who have made excessive returns.

Please note: We will not be able to provide a refund for a return without a Member Return Code.

Use of Service

We reserve the right, at our sole and absolute discretion, to charge the renter’s credit card and collect an alteration or replacement fee for any lost item or any item that is returned in a damaged or dirtied state that exceeds normal wear and tear. Fair alteration fees will be charged for repairable alterations. Replacement fees for lost or destroyed items will vary but will never be more than the product’s retail price minus the rental fee already collected by the renter’s credit card.

The entire content included in this Site, including but not limited to text, graphics or code, is copyrighted as a collective work owned by Club Splerin / Splerin and Associates

Permission is granted to electronically copy and print hard copy portions of this site for the sole purpose of placing an order with Club Splerin / Splerin or renting or purchasing our products. You may display and, subject to any expressly stated restrictions or limitations relating to specific material, download or print portions of the material from the different areas of the site solely for your own non-commercial use, or to place an order with us or to rent or purchase our products. Any other use, including but not limited to the reproduction, distribution, display or transmission of the content of this site is strictly prohibited, unless authorised by us. You further agree not to change or delete any proprietary notices from materials downloaded from the site.

Intellectual Property

Club Splerin / Splerin AND ANY INFORMATION ON THIS Site are INTELLECTUAL PROPERTY. As such, they may not be used or reproduced without prior written approval from us in connection with any product/service not affiliated with us. Club Splerin / Splerin Logo, www.splerin.com, all page headers, buttons, data, text, page footers, photographs, and any other content on the Site are the Intellectual Property of Club Splerin / Splerin and www.splerin.com

Warranty Disclaimer

This Site and the materials and products on this Site are provided "AS IS", "AS AVAILABLE" and without warranties of any kind, whether express or implied. Typographical Errors

In the event that any of our products is mistakenly listed at an incorrect price, Club Splerin / Splerin reserve the right to refuse or cancel any orders placed for product listed at the incorrect price. Club Splerin / Splerin reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Club Splerin / Splerin shall issue a credit to your credit card account in the amount of the incorrect price.

Termination

These Terms and Conditions are applicable to you upon your accessing the Site and/or completing the registration or shopping process. These Terms and Conditions, or any part of them, may be terminated by us without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Club Splerin / Splerin may terminate your membership or right to use the Site at any time for any reason, at our sole and absolute discretion.

Notice

Club Splerin / Splerin may deliver notice to you by means of e-mail, a general notice on the site, or by other reliable method to the address you have provided to Club Splerin / Splerin.

Use of Site

Harassment in any manner or form on the Site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a Club Splerin / Splerin or other employee, host, or representative, as well as other members or visitors on the Site is prohibited. You may not upload to, distribute, or otherwise publish through the Site any content which is libellous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of a minor or any party or which may otherwise give rise to liability or violate any law. You acknowledge that by providing you with the ability to view and distribute user-generated content on the site, Club Splerin / Splerin are merely acting as a passive conduit for such distribution and is not undertaking any obligation or liability relating to any contents or activities on the Site. However, Club Splerin / Splerin the right to block or remove communications or materials that it determines to be:

You agree to indemnify, defend, and hold harmless Club Splerin / Splerin , their officers, directors, employees, agents, representatives, licensors and suppliers (collectively the "Service Providers") from and against all claims, losses, expenses, liabilities, damages and costs, including all legal fees and costs, resulting from any violation of these Terms and Conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the Site using your Internet account. This provision shall survive the termination of your right to use this Site.

In an attempt to provide increased value to our visitors, Club Splerin / Splerin may link to Sites operated by third parties. However, even if the third party is affiliated with Club Splerin / Splerin, Club Splerin / Splerin have no control over these linked Sites, all of which have separate privacy and data collection practices, independent of Club Splerin / Splerin. These linked Sites are only for your convenience and therefore you access them at your own risk. Nonetheless, Club Splerin / Splerin seek to protect the integrity of its web site and the links placed upon it and therefore requests any feedback on not only its own Site, but for sites it links to as well (including if a specific link does not work).

Rental Service (From Club Splerin) Limited to United Kingdom and Mainland Europe ONLY (DIFFERENT ARRANGEMENT FOR OUTSIDE TERRITORIES)

This Rental Service (From Club Splerin) is currently available only to customers located in the United Kingdom and Mainland Europe. Customers wishing to purchase Splerin dresses can still do.  If you are outside of the United Kingdom and Mainland Europe, kindly refrain from using this Service from Club Splerin. However email store@splerin.com  with your request and we might SET UP “PURCHASE ONLY” Account for you. Club Splerin / Splerin make no representation that the Service and any content or products offered on the Service and their copyrights, trademarks, patents, and licensing arrangements, are appropriate or available for use in locations other than the United Kingdom and Mainland Europe.
